    1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

    It will be counted in the quota

    2. How sure about getting approval of H1B.

    Well, if you have a job offer for which you qualify and all relevant supporting documents, I dont see why you wont get the approval.

    It's Time to End Or Reduce The Cloture Clog (http://rollcall.com/issues/53_15/guest/19599-1.html) By Robert Weiner and John Larmett, July 31 2007

    Robert Weiner, president of Robert Weiner Associates Public Affairs, worked for 16 years in the House of Representatives and for six years in the Clinton White House. John Larmett, senior policy analyst at Robert Weiner Associates, was legislative assistant/press secretary to Rep. Jim McDermott (D-Wash.) and former Sen. Gaylord Nelson (D-Wis.).

    The Senate's cloture rule defeats democracy. It lets public servants hide and obfuscate behind a parliamentary quirk never intended by the framers of the Constitution. It's time to end or significantly change the cloture rule, as was last done in 1975, and move to a true democracy so that the House and Senate equally represent the American people.

    There are checks and balances, the only ones the Founding Fathers stated and intended: a presidential veto, which Congress can override with two-thirds, the only supermajority specified in the Constitution; the courts; and elections. No one ever foresaw parliamentary sleight of hand as a block of the will of the majority. If Congress wants to restore Americans' confidence in its work from the current all-time lows, it needs to allow the system to work as common sense, the Constitution and the framers dictate.

    During the April-May 2005 "crisis" on judicial nominations, the "Gang of 14," seven Democratic and seven Republican Senators, agreed to oppose the constitutional or "nuclear" option and to oppose filibusters of judicial nominations except in "extraordinary circumstances." However, the Senate has failed to cut off debate on other issues 57 times since then, making clear that the system has failed.

    Democrats are right to scream Republican "obstructionism," but Republicans, when they were in the majority, also were right to scream Democratic obstructionism. Both sides use and abuse the rule when they are in the minority to create some supermajority fantasy the public will not understand - and then blame the other side for not getting a legislative agenda accomplished.

    In last year's campaigns, House Democrats promised to change the way Congress does business - and do it within the first 100 hours they were in session. With a majority of 30-60 votes, but no supermajority requirement, the House passed its entire agenda. Despite majority support, hindered by the supermajority "cloture," the Senate has struggled all year just to pass a few bills. The American people get the feeling the Senate is a train that never quite leaves the station.

    The slow train continued July 17-18 when Republicans scuttled a Democratic proposal ordering troop withdrawals from Iraq in a showdown capping an all-night debate. The 52-47 vote fell short of the 60 votes needed to invoke cloture, the 27th time this year alone that body has been unable to proceed on significant pieces of legislation. In the previous Congress (controlled by Republicans), Democrats were successful 34 times in blocking Republican legislation. Cloture has become the third rail of Congressional politics. It's time for the train to move on a different track.

    Everyone has been properly complaining about obstructionism, but no one has said anything about changing the Senate rule on cloture. Since Majority Leader Harry Reid (D-Nev.) is talking about changing Senate rules to make it easier to restrict amendments on the floor, then why shouldn't the Senate also start the discussion about changing the cloture rule right now? It could be the difference in getting bills passed.

    In early July, the minority's decision to filibuster the amendment by Sen. Jim Webb (D-Va.), which stated that men and women serving in the military deserved the same amount of time at home that they served overseas, died on a 56-41 failed cloture vote - a majority supporting it but the media saying it "failed."

    In 1975, the Senate reduced the number of votes required for cloture from two-thirds to three-fifths, and it should change it again. If not an end outright, the best approach to guarantee the will of the majority, why not at least drop the requirement to 55 votes - necessitating just a little bit of extra consensus to end debate. Let the will of the American people, and of a majority of the Senate itself, be acted upon.

    It's time to end the cloture clog, regardless of who's in charge.

    Hi ,
    I have been residing in the U.S. (NY) since 0ct 2007 with an H4 visa. My dad had and still has an H1B visa. I have completed my high school here in the States only and now I am enrolled as a full time student in a college (in-state tuition). Now the problem is I will turn 21 this February and I believe I will no longer be a dependent on my father's H1 visa and would be residing "illegally". In that case what should I do? I want to complete my studies and stay here in the U.S. with my family and not be deported back to my home country all alone :(
    Is changing to F1 a good option for me ? I heard it could be risky? Is there any way I could have my studies going smoothly as it is now considering the out state tution under F1 would be too much...
    any suggestions and help would be greatly apppreciated

    My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.

    Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application

    Plss let me know at the earliest possible as I need to apply for change of status before may....!!!!!

    When a particular priority date becomes current in the next month's bulletin,say the July bulletin. Does USCIS start looking at the current cases once the July bulletin is issued or starts looking at them from July 1st.

    Considering many limitations to move a job from non-profit to for-profit, I am considering moving my job to another non profit. With my current employer, my 6 year H-1 B will expire by the end of next year April. So if my change my employer, I will have a very short time to start the process again till I reach I -140 approval again with the new employer.

    I heard that from non-profit to for-profit, you are subject to the quota and you have to apply for H-1B quota. But in this case, your previous 6 year with non profit doesn't count.

    But if I move from non-profit to non-profit, do I have to reach I-140 approval before my current H-1 B with my current employer expires? Or do I just get another 3 year with new non-profit employer?

    If I have to get I-140 approval with new non-profit employer before my current 6 year H-1 B expires, is it doable?

    Hi,


    My current status is

    I currently work for Company A (on H1B) and Company B is processing my GC (EB2, I140 approved; I485 in process) .

    This month, I found a new job with Company C which I have to join on EAD (they don't do H1Bs). Also, in this month's bulletin, my PD became current. I had a few concerns/questions

    1) Could the change in employment trigger any flags since I am changing companies and this is a future employment GC case (though its almost 3 years since the I-485 was filed)

    2) What do you suggest I do since its so close? I waited all this time just not to complicate things (and remain on H1) but then as soon as have to start work on EAD, the date also becomes current (which I am definitely very happy about ) but now since both these events are so close, I am not sure what to do.

    3) What other things are there to keep in mind in case of a future employment case?

    Hi all,

    My PERM labour certification was filed on 25th oct 2006, my case was selected for random audit on dec 06. My attorney replied with all the evidence for the audit. After reviewing the case CO at dol denied my case on Feb 07.

    My attorney has asked my case to be reconsidered/reopen on March 2007 as they are confident that they have supplied all the documents required for the case. My attorney says it will take 6-8 months for DOL reopen the case and judicate the same which is Nov 07. what is best option i have as all the dates are current now? i have discussed with my attorney they have told me clearly they are not going to reapply as its a very big company and it will take lot of time for me to get clearance to file my perm again.

    Does anybody having experience like my case can share your views it will be really helpful.

    All,

    I have my I140 approved under EB3 with the PD Aug'2003 with the employer A. Now I am planning to switch to employer B for filing Labor under EB2 category.

    My question is Can I avail the PD i.e Aug'2003 got from the previous labor EB3 (i.s employer A) for the new EB2 labor with employer B.

    My Exp: B.E + 8 Yrs of Progressive Exp.


    Employer A:
    labor : EB3 Approved PD AUG'2003
    I140: Approved

    Employer B:
    labor: EB2 under process.

    I would appreciate your reply, any attorneys pls.

    max, the problem is there is no clear cut definition of how an IO is supposed to respond to the scenarios you mentioned.

    but i suggest that you search IV archives as this subject has been discussed in-depth before. i remember 1 or 2 ppl posting their AC21 and subsequent GC approval experience via self-employment/ LLC registration.

    good luck. pls let us know ur future experience in this matter.
