everyone here talks abt geting GC asap.. even though most of us are swearin at the USCIS/DOS whtevr, deep down we all want GCs. but after thi sJuly VB, do u have faith/trust in the system now? assume that they accept our application and what if they give out GCs 2-3 yrsfrom now, what makes u think they cant come back and say it was a mistake and u have to give ur GC back?
If they can do what they did today, and get away with it, they can do anything. its no differnet from Telgi scam/Laloo gobar/chara scam, so many scams in india. they get away once, they get away again. the middle class/average/educated tax payers like us suffer.

Can I apply for AP renewal now even if my current AP expires in mid Oct 2009 or should I wait until the expiration date is 90 or 120 days (like H1 renewal).
My EAD expired last year and I have not renewed it, so I should be good on that (I am working on H1) but had a question on AP.

My situation is: last entry to US with F1 visa as a student. After graduated, got H1 visa, but didn�t leave US during the period.
When filling I485, need to answer the following questions.
1. In what status did you last enter?
For my case, should I fill �F1� here.
2. Nonimmigrant Visa Number, Consulate where visa was issued and issue date?
Does this refer to my H1 visa number? If so, since it is not issued by consulate, how I can answer the last two questions?

Our son was out of the country when we filed our 485 on July 2nd. Now he returned to US, how shall we file his AOS? Form I-485 or anything else? Shall we include a copy of our filing inside?
In addition, the I140 was approved after we filed. And the principal applicant went out of the country and applied H1 visas and returned also.
Shall we include the updated information of the principal inside or just the copy of the original filing?

Friends,
LUD on my I-485 (TSC) had not changed for the last two years and I now find a soft LUD of 09/15/2009. Has anyone experienced recent LUDs on their pending I-485?
I am asking because I am wondering whether USCIS has really 'touched' my file or if this is just a regular 'batch update' that happened to all applications, may be because of the new website migration.
Appreciate your answers.

My wife is currently applying for labor certification and I am planning to start my process for green card also. Is it advisable for both of us to apply for the green card? Is it considered duplication by the INS?
The reason for both of us starting the green card is that in case one of us has to move to a different job the other green card application might serve as a backup.
Please advise.

I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.
Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?

I am Cross Charging and applying for AOS filing. While filing do I need to provide BONA FIDE copies of Marriage & Birth certifcates. ??
Its mentioned in the application right? You need to provide certified copies of marraige and birth certificates matching your application

As per the new information USCIS is planning to finish receipt update by end of the month. My application was filed on July 19th and received by B Fisher at NSC. All the folks who applied with me got their checks cashed last week.
My I140 was approved from NSC last year.
How many people are in the same boat. I know from other threads there are still people waiting from July 2nd.

Has anyone seen this pattern before for any service center? A "processing times" entry missing? Could this be just an accident, or are they sending the I-140's to another service center? This could mean a LOT to people who sent their I-140's and I-485's concurrently to TSC.

I am on H1-B visa. I also have I-140, EAD and AP approved recently. I plan to send paperwork for my mom's tourist visa. Do I need to send I-485 receipt notice and copy of EAd or is it OK to send copy of latest H1-B approval?

I am kind of confused about my situation. Will try to detail it; any help is greatly appreciated!
I was working with company A until July 2009. They had filed my F1 to H1 COS Application in April 2009, which got approved. I have the receipt for that. I lost my job in July 2009 and found another one. My new employer, Company B, filed a NEW COS Application (which they said is subject to the H-1B cap, which is confusing cuz they could have used the receipt number from my previous approval I think)
Anyway, I contacted the attorney from Company B and they said I should call company A and have them cancel my H-1 COS Application. I called the attorney from Company A and she said she would cancel the H-1 Application. She also mentioned about ME having to send a letter to USCIS. Why do I have to send this letter? Is it so that I can go back to my F1 status? What should it say?? Please help!

The big news today was Senator Reid now backtracking and promising climate change legislation before immigration reform. But in a seeming effort to show the Democrats are close to ready to go on immigration reform, Senators Reid, Schumer and Menendez began circulating a detailed outline of a comprehensive immigration reform bill that appears to exclude Senator Graham. My wife couldn't get Xray on a failed TB skin test, because she was pregnant at the time we filed our 485. Our priority date will be current in August.
Should we wait for a RFE on her medicals? Or is it possible to go ahead and do it, and send an update to USCIS?

I also understand and have developed AfterEffects peices for web publishing purposes. So if you need Flash animation, I can do that too. My lastest work was a FLV and Flash intro peice for Enyce.

Public satisfaction with the job lawmakers are doing has fallen 11 points since May, to 24 percent, according to an Associated Press-Ipsos poll. That's lower than for President Bush, who hasn't fared well lately, either.
Bush has been taking heat over the Iraq war, his decision to spare a former top vice presidential aide from going to prison and his desire for an overhaul of immigration laws that critics said would give a free pass to illegal immigrants. His job approval rating in the AP-Ipsos survey remained virtually unchanged at 33 percent.
The 24 percent approval rating for Congress matched its previous low, which came in June 2006, five months before Democrats won control of the House and Senate due to public discontent with the job Republicans were doing.
Just two months ago, 35 percent of the public approved of Congress' work.
Poll respondents from both political parties say they're tired of the fighting between Congress and the White House, and want the two branches of government to work together on such issues as education, health care and the Iraq war.
"They don't approve of anything he does," Theresa Holsten, 55, a Republican and unemployed resident of Lawton, Okla., said of Congress. "He can't do anything right, according to what some people say. It irritates the living daylights out of me."
Tammy Lambirth, 42, a data researcher from San Antonio, disapproves of "all the fighting that they do all the time."
The latest tussle involves Bush's refusal to hand over documents and let former White House aides answer questions from the Democratic-controlled Congress about the firing of U.S. attorneys. The dispute could end up in federal court.
"The Republicans are just stonewalling everything, and the Democrats are just not stepping up and making them do what they need to do, especially about Iraq," said Lambirth, a Democrat. "They need to make our troops get out of Iraq."
While the public's approval of Congress has dropped 11 points since May, the percentage of Democrats who are turning up their noses at Congress - like Lambirth - nearly doubled. Among Republicans, though, not so much.
Approval among Democrats fell 21 points, from 48 percent in May to 27 percent.
It remained low among Republicans, at 20 percent, and has not changed significantly in the past two months.
Democrats won control of Congress on the strength of their promises to end the Iraq war, but so far have failed to do it. Bush vetoed one spending bill that included a deadline for ending the war, and Democrats don't have the votes to override him.
An increase in the federal minimum wage became law, but much of the Democratic agenda has cleared the House only to become bottled up in the Senate, where the party has a much narrower working majority.
Democrats need to be mindful of the public's satisfaction with Congress' productivity, especially as the party campaigns to win back the White House in elections next year, said political science professor Kenneth Sherrill.
"If you manage to persuade a very large number of voters, including an increasing percentage of people who associate with your own party that you're not capable of governing, you're in real trouble," said Sherrill, who teaches at Hunter College in New York City. "That is not a good message to send."
Among other survey findings:

Last month, Bush was at 37 percent approval for his stewardship of the economy, and 32 percent on domestic issues.

On handling the Iraq war, 31 percent approved, compared with 28 percent last month.
