You could be in H1 till Dec 2010. Nothing in the law states that your already approved H1 has to be revoked, with the PERM denial.

My sister, as part of submitting documents for her fiance visa application, recently got a birth certificate. However, it doesn't have her name on it. Odd as it sounds, the municipality says that this is common practice. It just has the name of the parents.
Is this acceptable for a fiance visa? Thanks.
Yes, if her parents are sponsoring for his visa :)

I just realised about this competition when I saw this on the main site "FXpression 09 Contest ends January 20th"
It ends at midnight PST, so you have about 15.5 hours from now :)

what do I have to do?
Will I be contacted by the Goverment via snail mail?
In general, how long more do I have to wait?

hi attorneys,
my H-1B petition is valid for another 3 months. we applied for my H1 extn and my spouse H4 extn 2 months ago. both r still pending.
my spouse H4 petition expired last month. since we applied extn b4 it expired, my spouse can stay in usa legally.
now my spouse wants to travel abroad for a family function.
questions:
(1) is it fine to travel abroad with H4 extn pending? (pls note that the H-1B holder will not be traveling)
(2) if H4 extn is approved with new I-94 when abroad and my spouse gets another new I-94 at POE when returning, then which I-94 will be the latest valid one?
thx in advance,

Last month, we spotted some language written by the State Department in the August Visa Bulletin which indicated that certain categories might advance rapidly in the September 2010 Visa Bulletin. And for many thousands of people, the September Visa Bulletin is a dream-come-true. Not for those with India and China employment-based (EB) priority dates who have waiting in line for much too long (Did you hear that, Congress?). For who then? For those in the worldwide EB-3 category for instance. For professionals and skilled workers, the numbers advanced over 5 months in September while for unskilled workers, the advance was...

There was an I-140 filed but it was denied and I never heard from my petitioner then. I do have the USCIS copy and case number. Can I look for another employer and atty that could reopen the case?? Please help me. Thanks

Please take a minute to upvote the the following immigration idea at
http://www.homelandsecuritydialogue.org/dialogue2/immigration/ideas/light-green-card-for-eligible-legal-immigrants-waiting-for-visa-numbers
Also I would like to see a comprehensive idea posted from IV and drive our members to upvote the idea so it will be on the top as top rated , most commented idea.
Whether DHS will follow through or not at the least we will be educating more people on our legal immigration woes.

Applied for Non RIR labor during April 2004 under EB2 in Ohio. Employer changed address (in same city) and one year before. Last week I came to know that Dallas BEC closed my labor case since they didnot recd the 45 day letter response from my employer. My employer requested Dallas BEC (with proof of informing them the address change) last week to re-open my labor case to continue processing the labor approval. My employer says it's better to apply for a new PERM as a backup.
Can the IV members advise me how to proceed on this?
Thanks.

I know this is dumb question to ask as I should not lie on the application and hide my previous application details but the question really is what all documents should I furnish from my existing application.

Hi,
I have been working with a company ABC from April 2007 in India. In Oct 2007 I got my H1B visa stamped for a company XYZ of USA and is valid thru OCT 2010. I took a long vacation here in India and went to USA for the company XYZ and stayed there for 45 days. During the period of stay I got my SSN and also I got one payslip generated for two weeks. Becoz of the market slowdown I had to return back to India and joined the same company ABC in India. Now this company ABC wants to process B1 for me, So is there any problem if I have to apply for B1 and is there any problem in the Embassy about the 45 days I spent in US on H1B while I was employed in a company ABC from April 2007?
Please suggest me on this asap
