Hello,
I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.
Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?
I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

My lawyer just told me, that Canadian citizens have the privilege to get H-4 stamped at the border & do not need to go the US consulates in Canada. Just wanted to ask that if this true and if someone has been through it.
Are there specific Land Borders where stamping can be done? or does it works at every Border post?
Is there a border post in the Minnesota or North Dakota area where this can be done? My wife lives in a small town in Manitoba.
Does she have to take all her pictures or will they take picture there for the visa? & what else would we need? non-immigrant forms etc. Any experiences?? I know they will need my H-1 Petition copy, pay stubs, marriage certificate, pictures of marriage etc.

Can I apply for AP renewal now even if my current AP expires in mid Oct 2009 or should I wait until the expiration date is 90 or 120 days (like H1 renewal).
My EAD expired last year and I have not renewed it, so I should be good on that (I am working on H1) but had a question on AP.

My company changed address while my transfer H1b petition was pending. We moved just across the street from the original location and thus the company did not call USCIS to notify them of the address change because we still had access to our old mail box. Unfortuanately my approval notice was returned back as undeliverable and I received an email to that regard.
The secretary from office called USCIS and had the address changed immediately, its already been a month but we still haven't received the approval notice at the new address...has any one else here has similar experience...how long do you think we should wait before we call the USCIS again ?

Whatever you call it, you are really always applying for a new EAD. There is no such thing as renewing an existing EAD. The I-765 form that you complete will ask about any prior EADs that you had. If you do not have details, please put as close to the facts as possible. If you still have a CIS receipt number, definitely include that so CIS can look up the details.

What a piece of work from the man who warned us about death panels in the health care bill. His grasp of the facts don't seem to be much better when it comes to USCIS' enforcement of H-1B rules. If you have receipt # you can check the status on uscis.gov, you can also call their 1-800 # to check what's going on with this application.

I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.
The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.
Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.
Your opinion would be appreciated.

My wife who is on currently in the US on H4 has recently received her H1B approval. Her H1B is valid from 01-Oct-2007 to 23-Sept-2010.
When we applied for the AOS in July 2007, we mentioned that my wife's current status was H4 (which I am thinking is still true as her H1B starts only on October 2007). My question is will this create an issue when USCIS is adjudicating our AOS applications.
Any information on this issue would be appreciated.
