I dont think I would trust your friend's cousin on that based on what I have read on here and other places. PD of aug-05 and EB3-I, I have my doubts, but if it is true, I am happy for him.

Technically, You AOS application provides you status. So, unlike on H1b, you can be without a job for a long strech of time. The problem arrives, when there is an REF on your I-485 application to show proof of offer. If you can show proof of employment, you should be fine. But, There is a possiblity that USCIS might ask you for recent paystubs or W2s. So, I wouldnt be without a job for too long.
At least this is my understanding of it. Anyone differing from this opinion?

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

i got married with my husband right before he filed his i-485, so we can file it together. His i-485 recently got approved, mine is still pending since March 2007. After speaking with IO, I found out that my name check is pending. My name is not common, I had no interaction with a law agencies in any way. So, I suspect that name check is just an excuse.
My question is, can my marriage to my husband just before i-485 filing be a reason I am still waiting? Has anybody experienced something like this? I'm not from a country where arranged marriages are common practice and we have a child together.

I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?
I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile. Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

Another thing I would like to mention. My I-140 got approved couple months back but applied I-485 during July 2007, so it's more then 180 days for I-485 not for I-140.
Any suggestion.
