Hello all, my apologies if you find my question naiive. We got our fingerprinting appt. notice in the mail yesterday with an EAC application no. When I look that number online it says case has been transferred to Texas and notice of transfer sent. Fine. I am not anxious or anything just wondering if a receipt will be generated now at Texas or would one have been generated at Nebraska and sent to the lawyer? The reason I as is I have been holding back travel plans and wanted to start looking at flights etc. if I know the receipt is either on its way or at the lawyer's already.

BTW the application was sent to Nebraska on July 30 and I140 had already been approved from Nebraska earlier this year.

Trying to use my EB3 date in the EB2 category
Just spoke to an IO at TSC, She told me that the case is at a place what they call "Pending Review and final decision"
I asked her whats the next step after this?
IO : Hope fully will be assigne to some one
I Asked, isn't this the place where all the cases are "Pending Review and Final decision"?
IO: a big NO...no no..this is not the place where all the cases are, I can't provide anymore info then this, I was just being nice because you called at 3:30 pm.
Any body who has thier case in the pool of "Pending review and final decision".
Honestly, I think its just a general status that she told me about my 485 case.

For an individual, let’s say an I-485 was pending since July 2007 (I-140 approved) with current employer A and she moves to an employer B on a similar job on a H1-B transfer invoking the AC21 portability.
1) After the move, if the I-485 gets denied, can the person still retain the priority date of the underlying approved I-140 in any new application if she files with the same or a new employer.
2) After the move, if the I-485 gets denied and the person loses her job with the employer B, can she take a job with employer C by transferring the remaining time on her H1-B visa.

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

My EAD and AP have the wrong birth date and I just noticed it. I have to re-send form I-765 and I-131 with the original EAD and original AP for correction. My case was originally filed in NSC along with 485, but I live in Texas.
But, as per instructions for I-765 and I-131, form should be filed at:
"Service Center with jurisdiction over your residence or Local Office - depending on where your case is pending."
Can someone guide me please ? Where should I file - TSC of NSC ?

Only during I 140 USCIS will ask for Exp letter whatever you showed in PERM. I think your previous exp should be related to your new job role.

Yes he is in 'Adjustee Status' also a person can start working as soon as new employer files H1 petition on his/her behalf. So if the petition was filed on time and took 40 days to be approved your friend was in H1 status since the day the petition was received by USCIS

My wife and my documents were delivered on June 6th and receipt date June 14th. My AP was approved on July 20th. However, my wife's is still pending though there are two date update since mine is approved - July 22nd and 27th. Anyone has the same situation?

Can we apply for I - 485 without having the I -140 receipt notice.What is the work around so that I dont miss the Aug 17,2007 date for filing I -485.Are there any chances that my I - 45 will be rejected, or will I ge an RFE.
My I - 140 was applied during the 2nd week of July, 2007.

I am working on EAD which I received from my EB3 category(labor date - Oct, 2004). My new employer filed a new application for EB2 category in Nov, 2010, my labor got approved within 3 months and they went for the next step filing my I-140 PETITION. They attached my previous I-140( from Eb3 category) along with the new application seeking to port the old priority date. Here is the REF which they received on 23, March 2011.
"Please provide evidence to show that the petitioner will be employing the beneficiary to fill the specific vacancy. In addition, provide a detail description of the work to be performed, including specific job duties, level of responsibility and number of hours per week of work to be performed.
You must sumbit the requested information within 30 days from the date of this letter. Failure to do so may result in the denial of your petition"
Please suggest. My attorney is working on this.

I need a suggestion . i am working on virgina state. and my employer is running the pay roll on newjersey state. I am sending emails to him but replying. I am working on from last year for that company. He is having backup amount (caustion deposit) nearly 7000$
