I am working for a small company on H1B since October 2006. The company had originally filed for full time employment (LCA and I-129) but at the time of hiring offered part time employment. I worked part time till June 2008 and since then I have been working full time. The company however never filed for an amended LCA and/or I-129 and I worked part-time on a full-time LCA and I-129. My H1B approval was extended last October by another 3 years. I also work part-time for a University on a concurrent H1B.
Will I be deemed out of status for this? What are the implications of this on filing for GC under EB1 or EB2? Is there any way in which this situation may be legally rectified?
Please advise.

The dude has been cranking out research papers, has bunch of patents and BTW, would be an H1B. Every univ gets fed funding one way or the other. Does it mean the dude cannot be hired by a US univ? Agreed, not every H1 is a genius, but every H1 is an immigrant who works his/her ass off, everyday contributing to americans' social security, medicare funds...

Hi
I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.
My question is where should I file my AP?. Do I need to file with NSC or TSC?.
Please someone respond.

Hi
I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.
I have 2 questions here.

Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.

This is my third EAD renewal. My 485 is pending at NSC. I am in CA. All my previous EADs/APs etc were filed at NSC.
This time when my EAD renewal is filed (by my new attorney, in new company) I got receipt Number starting with MSC.
Who decides where to file MSC? What's the criteria to file at MSC? Shouldn't it be file at NSC?
Is this a mistake?

I had the sample problem. There was an extra letter in the last name. I waited till the labor was approved and then notified USCIS while filing I-140. There was no issue. You do not have to worry about it

Got laid off two months ago. After some painful job search, I accepted an offer with paid relocation. Then that idiot in my head starts murmuring that I will have trouble with the "Same or Similar" requirement for using AC21.
Did anyone here ever get an RFE for employment verification after invoking AC21? How did it go?
I always think it's very difficult evaluating the similarity of two jobs by reading their job descriptions.

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. The time to get attention is now!

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas
