My friend opted for consular processing and he is now thinking it was a bad idea. He is in EB2, and his PD is sometime in 06 (not sure of the month)

only the photo-copies of all the documents they mentioned, each page notarized.
I got PIO card in exactly a week and I live in North west Ohio close to MI border.

I have a question about forming an LLC while being on H1B. I am entering into an agreement with an Incorporated company to provide my technical services to it and in return they need to give me a percentage of the revenue. Clearly, I cannot enter into this kind of arrangement as myself as I not authorized to work in the US. For that I am planning to form an LLC or an Incorporation and my company will enter into a contract with the other Incorporation. Is this legal or will this be construed as an effort to bypass H1B laws? I'll still be doing the daytime job and fulfilling my obligations that I have with the H1B sponsoring employer.
Please let me know your opinion.

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case

I have H 1B VISA but never went to USA....
1) now if i want to go there... will there be any problem
2) if I want to apply for another VISA work or Tourist... will i get?
You should not have a problem getting a different visa to come to the US to work or visit, assuming you qualify for the new status. It's not unusual for someone to get a visa that they never use.

Is core group out of mind...Sueing will waste our funds..
Please use this money for constructive tasks.
Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

Hi,

I changed my job in Aug-2008 and discontinued my H1B which is expired in Sept-2008. Now my only legal status is 'adjustment of status from H1B to Permanent Resident'. I think this is very common state most of the people waiting looong for GC fall into.
Now, I saw one of my friend's i-485 denied (with NO option to reopen!) bcoz an approved I-140 was not attached to this application. I agree that this is not simple mistake for USCIS can ignore, but there is always a 'very very remote' possibility that every application can be quetioned due to some flows in the filing.
Here is my question: Since I discontinued my H1B status and I am still in this country, can I apply for a fresh H1B? I am thinking because H1B quota is still open this year and to face any unexpected reason for 485 denial!

I have heard it is possible to change employer on 7th year of H1-B, though not immediately. The new employer should file LCA more than 365 days before the H1-B expires. Next time when renewing H1-B it can be renewed with new employer.

send them the business week article. In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and bothered to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.

Has anyone been in a situation where they joined a new employer after having completed 180 days after 485-filing, and sent in AC-21 documentation through an attorney?
If so, which attorney did you choose for the AC-21 paperwork?
- The old attorney, that represented you and your ex-employer, and filed your labor, 140, 485, EAD, AP
- or the attorney representing the new company
- or a third attorney that you went and found on your own
What do you think is the best way to go, if there is a best way to go?

I heard that if the filing of the 140 /labor /485 (any of them) have the filing date < 1 year at the end of the 6 year of h1b then I can not extend my H1B for the 7th year.
Questin: Is this correct?

Filled labor in june 2007.
Filled 140 /485 in aug 2007
6th year H1B completed in feb 2008.
Question: Am I eligible for the 7th year h1b extension?
If yes then for how many years of extenstion I get?
If not then please suggest what to do.
Note : I have not changed my employer since last 3 years.

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?
