Well seems like today both sides are going to blame each other for not having a bill today. Big question is - does discussions/negotiations re-start after the recess or is this issue pretty much dead. Most probably they will announce that they will re-start the discussion after vacation and provide the "most important legislation"...blabla... But what are the chances really? especially with new scandals beginning to take all the headlines. This is really frustrating and unfortunate. Lets see how the day goes.

Hi Gurus,
Request your help on my query. I am on H1B with an I 797 valid upto 29-Jan-2011 and dependants have stamped H4 visas valid upto 29-Jan-2011. My company is in the process of applying for my H1B extension (this will be my second extension and i have currently completed 4 yrs 9 months in US).
My dependants are planning to travel to India at the end of this month and plan to return back by end of Nov. Will they face any issues during their return at POE ?
Will there be any complications with our visa extensions ?
Appreciate your response at the earliest.

Even i have the same situation, i got my AP approved and mailed, but my wife's still pending, even my recieved date was 13th june.

Yes, that is accurate. You cannot convert from a Student Visa (F1 visa) to a Resident Visa (Green Card). The F1 visa is not a dual intent Visa. You have to have and H1B or L1 Visa to apply for a resident visa. Generally it is taking Chinese citizens who apply for residency in the employee based 3 or 2 categories. (EB3 or EB2) several years to get their GCs.

The application has been pending since 2001, so I decided to first threaten USCIS with a lawsuit, and then maybe file a writ of mandamus. My question is whether I have authority to do so as a dependent. Can I represent the whole family or at least myself? My father is leaving the country for some time and it will be hard for him to participate in the process.

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?

I had FP done way back in October 07..but there is no status change LUD on I-485..what to do??.:confused:..Do I take an appointment to talk to an officer or simply call USCIS ..

I filed I-131 for AP renewal around 10th August and received a Biometrics appointment notice for I-485 yesterday. Is there Fingerprinting required for AP? If yes, why is the Case Type on the notice I-485? Or is the FP notice for I-485 and it is just a coincidence that I have filed for AP renewal. My PD will be current next month...

I am starting my employment based GC process. My employer is going to file for my labour certificate (LC) thru PERM soon.
However, I want to know what happens if you Labour Application is not approved by USCIS?
like - Can you then apply for Labour thru another employer? or start ur Green Card process thru another employer.
- Can you get H1 extension after 6 year period is complete?
Kindly advice.
